DFG Cutbacks
We're hearing a lot about DFG cutbacks., now that we all have purchased our licenses. This morning I discovered a confirmed report that DFG is not stocking Eastern Sierras south of Bishop. And we've all heard about the several hatcheries in peril of closure.
Yep, this really sucks. And when you think about it, the state is actually perpetrating a fraud.
We purchase a fishing license to fish. We do this with the full understanding that we will be able to fish in the routinely stocked waters identified at the time of purchase. After we make our 'good faith' purchase, the seller (State) decides not to stock. Hence, we're left with a meaningless piece of paper.
Is this a form of bait and switch? At least.
Is it similar to purchasing a theater ticket for a particular venue in a particular theater ... and then being told 'that' theater will not have the intended venue., but you're welcome to sit in the theater anyway? If this is so, we would be able to refund our tickets.
When I goto McDonalds and purchase a big mac, I expect to see a hamburger in the package. Not an empty carton and an 'oh well' from the #### who sold it to me. Could a merchant simply state that they can't afford to deliver the product, service or 'privilege' you purchased? And tell you to simply accept it?
Did the State perpetrate a fraud? Was the 'pre-opener' stocking merely a ruse to ensure that the majority of annual license purchases transacted, before they pulled the plug? Looks that way to me.
I'm a businessman. And I know., if you're selling chickens ... if you take the buck, you had better deliver the cluck. If you took the buck with no intention of delivering the cluck, you're guilty of perpetrating a fraud. If not, then you owe the buyer a refund, period!
AB2280 will take a long time to hit the books. I have no idea when, but I'm not expecting it to be on the books and enforced until next year (maybe).
Clearly we've been had, suckered, bamboozled and robbed. They've perpetrated a fraud and placed the State's finanacial burden on the backs of California's Trout Fishermen.
Tell me you don't feel suckered...
Does the term 'class action' ring any bells? That would probably get quicker results than AB2280
I already have tons to do, but I'm gonna put this iron on the stack and check into it. You havn't heard the last of me yet :angry:
I sent an email to a law fim in sacramento that specializes in Class Actions. Maybe we have a case or maybe we don't. We'll know soon enough.
The only thing I like more than Trout fishing is righting a wrong.
